Use of the Bee-Haviour website is offered to you on the condition that you accept the terms, conditions, and notices contained on this page and on other pages of this website.

You agree to read these terms, conditions and notices carefully before using the Bee-Haviour website. You may not access or use this website unless you agree to them. By using this website, you acknowledge that you have read the terms, conditions and notices in this Agreement and you agree to accept them. Bee-Haviour reserves the right to change the terms, conditions and notices under which this website is offered at any time at its sole discretion.

Personal and Non-Commercial Use.  This website is for your personal, non-commercial use. You may download and copy information on this website for your own personal use as long as you maintain all copyright and other notices contained in the content. You may not download, copy, reproduce, modify, distribute, publish, transmit, transfer, sell, license, display, perform or adapt any information, products or services obtained from this website. Any files downloaded from this website is subject to the terms and conditions and copyright of the author.

Unlawful and Prohibited Use.
  You warrant that you will not use this website for any purpose that is unlawful or prohibited by the terms, conditions or notices in this Agreement and on this website.

Prohibited Activities.  When using this website's discussion forums, e-mail services or other message or communication facilities, you agree that you will not use the website to:

  • Post or otherwise transmit any communication or material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, disruptive to the site, hateful, or racially, ethnically or otherwise objectionable;
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through the website;
  • Upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation except as otherwise expressly authorized by the Bee-Haviour;
  • Disrupt or interfere with the operation of the website or any servers or networks connected to the website service;
  • Violate any applicable local national or international law;
  • Collect or store personal data about other users.


Access Restriction.   Bee-Haviour may, in its sole discretion, deny any user access to this website or any portion of the site without notice.

Indemnity.  You agree to indemnify and hold Bee-Haviour harmless from any and all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) which arise out of, are connected with or directly relate to your wrongful or unlawful use of this website or any breach of any representation or warranty made by you in this Agreement.

Use of Information. Bee-Haviour may monitor your use of this website. It may use and disclose any information and material received from you, or collected through your use of the site, for any lawful reason or purpose. For complete information, please see the Privacy Policy.

Links to Other Websites.   This website may contain links to websites operated by parties other than Bee-Haviour. The links are provided for your convenience only. Bee-Haviour does not control the websites and is not responsible for the content on such websites. By offering links, Bee-Haviour is not implying that it endorses anything contained on such websites or has any association with them.

Returned Merchandise.   If you are ever dissatisfied with a product you have purchased from Bee-Haviour, you may return it to us for a replacement or refund within 30 days of receipt. Please follow all instructions below when returning merchandise:

  1. The customer is responsible to pay shipping costs on all returned items.
  2. Include a completed Return/Exchange Authorization Form in its entirety stating the reason for the return.  Click here to access the form.
  3. Item(s) must be returned within 30 days of original receipt.
  4. Item(s) must be in “like new” condition. Item(s) not in “like new” condition will not be eligible for refund.
  5. A copy of your original receipt is required. If you are unable to supply a copy of your receipt, please call and we may be able to get you a copy.

NOTE: Bee-Haviour is not responsible for items being returned to us which are lost or damaged. Please keep a copy of your tracking information, and it is recommended you include shipping insurance when returning items to us.

Exchanges.   Please follow all instructions when sending back an item for exchange:

  1. The customer will be responsible for paying return shipping costs on all returned products as well as the shipping on any new item sent in exchange.
  2. The customer is responsible to pay any cost differences for products exchanged. 
  3. Fill out the Return/Exchange Authorization Form completely, noting you would like to exchange the item as well as the item number, quantity and description of the new item(s) you would like in exchange.
  4. Exchanges must be made in within 30 days of original receipt.
  5. Item(s) must be in “like new” condition. Item(s) not in “like new” condition will not be eligible for exchange.
  6. A copy of your original receipt is required. If you are unable to supply a copy of your receipt, please call and we may be able to get you a copy.

NOTE: Bee-Haviour is not responsible for items being returned to us which are lost or damaged. Please keep a copy of your tracking information, and it is recommended you include shipping insurance when returning items to us for exchange.

 

Replacing Damaged or Wrong Merchandise.   If item(s) arrive damaged or the wrong merchandise was sent, please contact us immediately so we can resolve the issue. When a situation occurs where Bee-Haviour is shipping another product to you as replacement for damaged or incorrect product, there will be an additional charge for the new product sent and a credit applied at time of the return of the incorrect product. Bee-Haviour will include a return call tag shipping label, inside the replacement package, that will expire 30 days after it is issued.

Privacy Policy.
  We appreciate the trust you place in Bee-Haviour, and we are committed to respecting your privacy and the security of your personal information. Bee-Haviour never knowingly shares customer information with third parties.

Orders.   Orders placed after 2PM EST are processed the following business day. Orders placed from Friday 2PM EST – Monday 8AM EST will not processed until Monday at 8AM EST.

Shipping and Estimates.   Currently we are only able to ship inside the Continental United States. Live or packaged bees are not available for shipping via the postal service. Although we try to be accurate with shipping charges, some circumstances can affect the final cost. If the cost to ship your order is higher than what you were quoted during checkout, we will contact you before we proceed with shipping.

Accepted Methods of Payment.  Visa, Discover, MasterCard, American Express or PayPal.

Credit Cards.  Bee-Haviour reserves the right to preauthorize credit and/or debit cards. No money leaves your account until the purchase clears but the hold is active until the actual transaction is settled. When there's a hold on your account, it lowers your available balance. Bee-Haviour is not responsible for overdraft fees resulting from the pre-authorization of your card.

Special Orders/Custom Orders.   Special and/or custom orders may require a deposit. Please contact us for more information.

Order Discrepancies.   Check all orders immediately upon receipt and contact us within 48 hours on any discrepancies.

Prices.   Bee-Haviour will invoice all orders on the basis of prices which are in effect at the time of shipment. We reserve the right to change product prices if we deem it necessary. Please feel free to confirm prices at any time. Bee-Haviour is not responsible for typographical errors.

Liability.   Our liability is limited to the purchase price paid for any item. We make no warranty or representation, express or implied except all products conform to the description provided by the manufacturer on sales literature or product labels.

State Sales Tax.
  When applicable, we are required to collect sales tax by law. Exemptions for sales tax will be allowed if you have either a signed Certificate of Resale or an Exemption Certificate. The tax forms vary by state, please call for details. Law requires that we have these certificates on file before any tax exemption can be allowed.

Holiday Closings.  We are closed New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and the following Friday, Christmas Eve and Christmas Day and thus will not process/access any online orders, phone messages, or emails until the following open day of business.

Queens.   Queens are guaranteed to arrive alive at the address you provide to us or be alive when you pick them up at our address or other location - but we do not guarantee that a queen or queens will be successfully introduced to or will be accepted by your hive. Many factors outside our control influence queen introduction success, particularly the specific methods and apicultural techniques you employ when introducing a queen. You also agree that you will not hold Bee-Haviour responsible for queen survival in your hive, or for the condition or productivity of your hive after introduction. Queens and risk of their loss become the responsibility of the customer at the time of pick up or upon delivery to the customer or customer's address. If a shipment arrives with a dead queen then you agree to contact us within 24 hours of receiving the shipment via email or phone. When emailing, please include your name and details about your shipment. Photographs are always helpful. Additionally, even if one or more attendants are dead, you agree to immediately hive or introduce the queen into a colony. Report the circumstances to us within 24 hours if the queen arrives with more than 4 attendants dead.


Package Bees.
  Prices on Bee-Haviour Package Bees includes a mated and marked Queen. Three pounds of bees contain approximately 10,000 workers. You agree that Package Bees and the risk of loss of the package and queen it contains become the responsibility of the customer at the time of pick up or delivery to the customer or customer's address or agent. Package Bees are guaranteed to contain 3 or more pounds of bees when the package is prepared and will not have more than one inch of dead bees (when spread evenly across the bottom of the package) upon customer pickup or upon delivery to customer, customer's address or to customer's agent. You understand that we do not guarantee that you will be able to successfully establish a colony or "hive" the package. You agree that you will not attempt to hold Bee-Haviour responsible for whatever may happen to your package after it is delivered to you or for the survival or productivity of the hive that you may establish from the package. If, in the extreme circumstance, the package arrives and your queen is dead on arrival, but there are still live bees in the package, then hive the package and place the dead queen in with the bees to hold them, and we will issue you a new queen. You agree to keep the dead queen with the bees and hive the surviving bees in the package as soon as possible in the usual fashion in any event. If, in the extreme unlikeliness, a shipment arrives with all or nearly all of the bees dead or the package is damaged (with more than one inch of dead bees spread evenly across the bottom) then you agree to contact us within 24 hours of receiving the shipment by email or phone. 

Prices on Colonies includes a mated Queen, 8 frames of bees and brood. Colonies and their risk of loss become the responsibility of the customer at the time of pick up or upon delivery to the customer, customer's address or to customer's agent. Colonies are guaranteed to be delivered alive - but you agree that you will not attempt to hold us responsible for the successful transport, handling, or subsequent survival or productivity of the hive. You agree that we do not a guarantee hive life span or production. 

Please note that all live bee purchases are non-refundableDue to the limited quantity of bees available, all live bee purchases are non-refundable. You may cancel your order, but you will not get your money back. Once you select an install/delivery date, it cannot be altered without written consent of Bee-Haviour. 

Our live bees are only available in the spring and early summer, so be sure to order yours today, as quantities are limited!
